Terms of service

These terms and conditions of sale apply to all purchases made via www.bomulia.no.
When you make a purchase, a binding agreement is entered into between you and Bomulia AS.

Online shopping is regulated by Norwegian law, including the Contracts Act, the Consumer Purchases Act, the Marketing Act, the Right of Withdrawal Act, the E-Commerce Act and the Personal Data Act. These laws give consumers rights that cannot be waived by agreement.

Buyer:
The consumer who places the order.

Bomulia AS does not enter into agreements with minors under the age of 18 without the consent of their guardian.

2. The Agreement

The Agreement consists of:

  • these terms and conditions
  • information provided in the order solution
  • any separately agreed terms

In the event of a conflict, separately agreed terms shall prevail, as long as they do not conflict with mandatory legislation.

3. Prices

All prices are stated in Norwegian kroner (NOK) and include VAT and any applicable taxes.
Any shipping costs will be stated before the order is completed.

No other costs will be incurred than those clearly stated before the purchase.

4. Order and conclusion of the agreement

The agreement is binding when the order is received by Bomulia AS.

If there is an obvious typographical or pricing error that the buyer should have reasonably understood was an error, Bomulia AS reserves the right to cancel or correct the order. In such cases, the buyer will be contacted without undue delay.

5. Payment

Payment is charged when the item is shipped from the warehouse.

We offer secure payment by card and invoice.

When paying by card, the amount can be reserved when ordering and charged when shipping.

When paying by invoice, the payment deadline must be stated on the invoice and be a minimum of 14 days from receipt.

6. Delivery

Delivery is considered completed when the goods have been received by the buyer or their representative.

If a delivery time is not stated, the goods will be delivered without undue delay and no later than 30 days after ordering, cf. the Right of Withdrawal Act.

7. Risk of the goods

The risk of the goods passes to the buyer when the goods are delivered in accordance with point 6.

8. Right of withdrawal

You have the right to cancel your purchase within 14 days from the day you receive the goods, in accordance with the Right of Withdrawal Act.

To exercise your right of withdrawal, you must clearly notify us before the deadline expires, for example, by email. You can use the standard withdrawal form, but this is not mandatory.

Return using the right of withdrawal

  • The item must be returned within 14 days of the right of withdrawal being notified
  • Buyer covers the costs of return
  • The item must be returned in proper packaging

You can examine the item in the same way as in a physical store. If the item has been used more than necessary to determine the nature, properties, and function of the item, we may claim compensation for any reduction in value.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to:

  • sealed goods that, for health or hygiene reasons, are not suitable for return if the seal is broken

9. Refund in case of withdrawal

If the right of withdrawal is validly exercised, the purchase price will be refunded without undue delay and no later than 14 days after we have received notification of the right of withdrawal.

We may withhold the refund until the item has been received in return, or until the buyer has provided documentation that the item has been returned.

Refunds will be made using the same means of payment used for the purchase, unless otherwise agreed.

10. Complaints

If the product has a defect, the buyer must complain within a reasonable time after the defect was discovered or should have been discovered. Complaints must be made in writing.

The consumer's rights under the Consumer Purchase Act apply in full.

11. Uncollected packages

If a package is not collected and returned to us, the buyer may be charged for actual costs associated with shipping and handling.
This does not apply to the valid exercise of the right of withdrawal.

12. Personal data

Bomulia AS is the data controller for personal data processed in connection with purchases.

Information is only processed to the extent necessary to complete the order or where there is a legal basis.

13. Dispute resolution

Any complaints should be addressed to the seller within a reasonable time. We will try to resolve the matter amicably.

If this is unsuccessful, the consumer can contact the Consumer Council for mediation.
